Terms of Service

By downloading, installing or using Fluence, you agree to be bound by these Terms of Service. Please read them carefully before purchasing.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Fluence ("the Software"), a desktop application developed and distributed by Eduardo Olíhez ("we", "us", "our"), accessible at fluence.eduolihez.com.

By purchasing, downloading or using the Software, you confirm that you are at least 18 years old and agree to these Terms in full.

2. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to install and use the Software on one (1) device per license key, subject to the terms below.

The Starter and Growth plans include a license for 1 device.
The Pro plan includes a license for 1 device but allows management of up to 3 Instagram accounts.
You may not sublicense, resell, rent, lease or otherwise transfer your license to any third party.
You may request a license transfer to a new device by contacting support. We allow one transfer per 90-day period.

3. Permitted Use

The Software is intended for personal and professional Instagram growth management. You may use the Software to:

Automate follow, unfollow and engagement actions on Instagram accounts you own or manage with explicit authorisation.
Track and analyse your own account performance data.
Manage up to the number of Instagram accounts permitted by your plan.

4. Prohibited Use

You agree not to:

Use the Software on Instagram accounts you do not own or do not have explicit authorisation to manage.
Use the Software in violation of Instagram's Terms of Service or Community Guidelines.
Reverse engineer, decompile, disassemble or attempt to extract the source code of the Software.
Use the Software to harass, spam or abuse other Instagram users.
Distribute, share, or resell your license key or the Software to third parties.
Use the Software for any unlawful purpose or in violation of any applicable laws.

5. Instagram Compliance

Fluence operates by automating actions within Instagram. You acknowledge and agree that:

Instagram prohibits the use of automated tools under its Terms of Service. Use of Fluence is at your own risk.
We are not affiliated with, endorsed by, or connected to Instagram or Meta Platforms, Inc.
We cannot guarantee that your account will not be restricted, suspended or banned by Instagram as a result of using the Software.
You are solely responsible for ensuring your use complies with all applicable platform policies.

6. Payment & Plans

Fluence is sold as a one-time purchase. There are no recurring fees or subscriptions unless explicitly stated.

All prices are in Euros (€) and include applicable taxes where required by law.
Payment is processed at the time of purchase. Licenses are delivered digitally after payment confirmation.
Plan upgrades are available by contacting support. We apply the price difference as credit towards the upgrade.

7. Refund Policy

We offer a 7-day money-back guarantee. If you are not satisfied with the Software for any reason, contact us at [email protected] within 7 days of purchase for a full refund.

Refunds will not be issued after 7 days from the date of purchase, or if the license key has been used to activate the Software on more than one device.

8. Updates & Support

Your license includes all future updates to the Software at no additional cost. We provide email support at [email protected]. Response times vary by plan (standard, priority, dedicated).

9. Disclaimer of Warranties

The Software is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Software will be error-free, uninterrupted, or that it will meet your specific requirements.

We make no representations about the results you may achieve using the Software, including but not limited to follower growth, engagement rates or account performance.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Software, including but not limited to loss of followers, account suspension, loss of revenue or data.

Our total liability to you for any claim arising from or related to the Software shall not exceed the amount you paid for your license.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Software after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
